When it comes to being prepared for emergencies, incidents (that are reported to the police) or disasters...we always suggest that any prospective client of ours interested in the services we offer, check with your legal department regarding laws and regulations regarding; emergency plans, shaing documentation with emergency services, organizing a respoonse team and training team members.


How does the law read for your facility or school? If your company has more than 10 employees, you need to review OSHA 1910.38.(See Codes).  If you are a public school, charter school, vo-tech or intermediate unit (IU) in Pennsylvania, review PA Code Cite: 22 Pa Code Chapter 10, Safe Schools,specifically § 10.24, and Appendix A (Model Memorandum of Understanding) (See Codes)


Are there penalties? What will happen if the building owner or school district is negligent and there is an injury or death during an incident or disaster where police or fire were NOT provided the required information annually or at the moment of the "incident" or "disaster"? 


Will the injured parties sue the owners or the school district?  Most likely "Yes". How will courts view the actions of the building owner or the school district if they had complied with their emergency regulations versus if they had NOT complied? What is meant by "due diligence? Would it make a difference in the award judgement? Is that important?


We strongly suggest that building owners and school districts check not only with their legal counsel, but also with their risk manager or insurance agent.
